    Anthony Fauci Invokes Fifth Amendment 111 During Senate COVID-19 Hearing

    Former White House chief medical adviser Anthony Fauci repeatedly invoked his Fifth Amendment right against self-incrimination during a Senate hearing examining the U.S. government’s response to the COVID-19 pandemic and the origins of the coronavirus. (reuters.com)

    The hearing, held before the Senate Homeland Security and Governmental Affairs Committee, saw Fauci decline to answer more than 100 questions from lawmakers, invoking the Fifth Amendment on the advice of his legal counsel. Among those questioning him were Republican Senators Rand Paul and Josh Hawley.

    During the proceedings, Hawley asked Fauci a series of questions, including one about the colour of his tie, to which Fauci also invoked the Fifth Amendment. The hearing became increasingly contentious, with Paul successfully requesting the removal of one of Fauci’s attorneys after a dispute over the conduct of the proceedings. (wsj.com)

    Following the hearing, Paul said the committee intends to consider whether to recommend holding Fauci in contempt of Congress for refusing to answer lawmakers’ questions. Any contempt referral would require committee approval, a vote by the full Senate and action by the U.S. Department of Justice before criminal proceedings could begin.

    The legal issues surrounding the hearing are complicated by the broad presidential pardon granted to Fauci by former President Joe Biden before leaving office in January 2025. The pardon covers potential federal offences connected to Fauci’s government service during the COVID-19 pandemic, although legal experts note it does not automatically resolve every constitutional issue surrounding his decision to invoke the Fifth Amendment.

    President Donald Trump said he respects Biden’s decision to issue the pardon, describing presidential pardons as among the most powerful authorities available to a U.S. president.

    The hearing also drew attention to excerpts from Fauci’s personal diaries released by Senator Paul. The journals include entries reflecting on the intense media attention he received during the pandemic, with Fauci describing the level of public recognition as “explosive” and writing in one entry that he had become “one of the most recognizable” people in the world.

    The Senate hearing is part of ongoing congressional scrutiny of the federal government’s handling of the COVID-19 pandemic, with lawmakers continuing to examine decisions made during the public health emergency and the origins of the virus.
